JusticeMakers Fellows: Shananur Islam

Mrs. Kolpone, a 36 year-old woman and mother of a ten year-old girl, was arrested in July 2009 by the Paltan police station in Bangladesh, alleging that she had stolen two gold bangles along with some  money. Although the police were not able to recover any of the stolen goods, she was put into custody. Two and a half years passed and she was still in jail without a trial, as she was unable to appoint a lawyer.

In Feburary 2011, attorney Shahanur Islam, 2010 JusticeMakers Fellow from Bangladesh, took up Mrs. Kolpona’s defense and conducted an interview with her at the Dhaka prison center. One year later in April 2012, Shananur Islam and attorney Mohammad Alamgir, from JusticeMakers Bangladesh, appeared in the Metropolitan Magistrate Court of Dhaka and got her released from custody.

This is only one of the many cases that our 2010 JusticeMaker Fellow solved by providing direct support to the victims of human rights violations and injustices. Furthermore, by conducting a fact-finding investigation, he found out facts which helped to lobby the authorities by issuing urgent appeal, which was helpful in receiving justice.

During his project execution, he also ran training sessions to reduce torture and promote respect for human rights. Professionals from a variety of sectors attended these sessions: lawyers, police officers and prison officials, journalists, judicial officials and human rights activists. These people then joined the unofficial network of people around the world battling against torture and other human rights violation.

It wasn’t easy for Shananur Islam to implement his project. He faced a lot of challenges while doing his job: “I have received repeated threats, death threats, intimidation, arbitrary arrest, detention, ill treatment, physical assault and harassment by the law and security personnel and also from local pressure groups due to my activity and voice against torture,” claims our JusticeMakers Fellow.

The project period has since passed, and all the proposed activities have been completed in a timely fashion. “I think my participation was interactive and the victims who received direct support are pleased and grateful about our [IBJ's] support”, says Islam.

However, as a human rights defender, 2010 JusticeMakers Fellow Shahanur Islam is continuing his activities upholding human rights in Bangladesh. He is still working for the victims of torture and extrajudicial killing as well as victims of injustice who may be in prison due to financial inability, and people living in vulnerable conditions. The professionals trained during his JusticeMakers project are  assets to him, supporting him continuously by providing information and assisting additional people.

“The project is good enough, but for better results, we need to continue it in the long-term. We need to make a strong network in every district and build a core group of volunteers to help us conduct the training lessons, fact find, issue urgent appeals, and other activities”.

JusticeMakers Bangladesh assists a woman victim to get release from jail custody.

 Kollpona, 36 years old woman mother of a ten year’s old daughter who had been arrested in July 2009 by the Paltan police station under Dhaka Metropolitan police from house of her master alleging to steal two gold bangles along with some cash money. Though the police was not able to recover any stolen goods, she was put to the jail custody. Then, around two and half years passed, she was in jail custody without trial being unable to appoint a lawyer.

JusticeMakers Bangladesh came to know about the incident in this year and took initiative to release her from the jail custody. On February, 2011, Advocate Shahanur Islam, founding secretary general of JusticeMakers Bangladesh took up Mrs. Kolpona’s defence and conducted interview with her at Dhaka prison centre.

 

Then, on April 03, 2012, Advocate Shahanur Islam and Advocate Mohammad Alamgir from JusticeMakers Bangladesh appeared to Metropalitan Magistrate Court, Dhaka for bail on Mrs. Kolpona’s behalf and finally she got release from the jail custody.

 গত ০৭/০৬/২০১২ ইং তারিখ সময় আনুমানিক ৭.৩০ মিনিটের সময় ব্যাক্তিগত কাজে মানবাধিকার সংগঠন জাস্টিসমেকার্স বাংলাদেশের তথ্যানুসন্ধান সহযোগী গনেশ রাজবংশী ডিএমপি, ঢাকার হাজারীবাগ থানাধীন ট্যানারী মোড় এলাকার তুলা গাছতলার পার্শ্ববর্তী হেলাল ট্যানারির গলিতে উপস্থিত হলে ৪/৫ জন অপরিচিত ব্যাক্তি তাকে জাপটিয়ে ধরে নাকে মুখে ক্লোরোফর্ম যুক্ত ভেজা কাপর চেপে ধরে অজ্ঞান করে হাত-পা ও চোখ-মুখ বেঁধে অপহরণ করে ঢাকাস্থ হাজারীবাগ থানার মিতালী রোড সংলগ্ন “রোজ বিল্ডার্স” কর্তৃক ভবন নির্মাণের জন্য নির্ধারিত টিনে ঘেরা স্থানে নিয়ে যায়। সেখানে মিরপুর রিজার্ভ অফিস, ডিএমপি, এর সদস্য পুলিশ সদস্য রুমেন দে এবং রাজনৈতিক সন্ত্রাসী সুজন রায়, আকাশ শীল সহ ৫/৬জন অপরিচিত ব্যাক্তি তাকে লাঠি ও বোতল দিয়ে আমাকে এলোপাতাড়িভাবে বেধড়ক মারপিট করতে থাকে। এ সময় তারা বলতে থাকে যে, “শুয়ারের বাচ্ছা, মানবাধিকার কর্মী হইছস, শালার পাছা দিয়ে আজ মানবাধিকার ঢুকিয়ে দিব”। এসময় তারা আরও বলে যে, “এই হারামজাদাকে আজ শেষ করে দেই, এরপর এই শালার ওস্তাদ বালফালানা আইনজীবী ও জাস্টিসমেকার্স বাংলাদেশ এর প্রতিষ্ঠাতা মহাসচিব এডভোকেট শাহানূর ইসলামকে শেষ করে দিয়ে এদের মানবাধিকার করার সাধ আজীবনের জন্য বুঝিয়ে দিব”। এসময় মি। গনেশ জ্ঞান হারিয়ে ফেলে। কিছুক্ষণ পর তার জ্ঞান ফিরে আসলে বাঁচতে চাইলে তাকে দু’লক্ষ টাকা দিতে হবে, অন্যথায় তাকে হত্যা করার হুমকি প্রদান করে। মি। গনেশ সামান্য একজন মানবাধিকার কর্মী, এত টাকা তিনি কোথায় পাব তাই টাকা দিতে অস্বীকার করলে সন্ত্রাসীরা তাঁর গলা চেপে ধরে হত্যার চেষ্টা করে। এসময় তারা তাঁর মুখের ভিতর গামছা ঢুকাতে থাকে, একই সাথে দুই কান ও নাকের ভিতর বাঁশের শলাকা দিয়ে খোঁচাতে থাকে এবং দু’ চোখের ভিতর আংগুল দিয়ে চোখ তুলে নেওয়ার চেষ্টা করে । ফলে ফলে তাঁর নাক কান দিয়ে দর দর করে রক্ত বের হতে থাকে। এসময় তিনি আবারও অজ্ঞান হয়ে পড়ে। কিছুক্ষণ পর জ্ঞান ফিরলে সন্ত্রাসী গন তাঁর হাত পায়ের বাঁধন খুলে দিয়ে একটি চেয়ারে বসিয়ে হাত পিছন মোড়া করে চেয়ারের সাথে বেঁধে ফেলে। তারপর, তার সাথে মোবাইল ফোন সেট এবং নগদ ৫০০০/-(পাঁচ হাজার) টাকা ছিনিয়ে নেয়। অতঃপর, তারা মি। গনেশ আর কোন দিন মানবাধিকার সুরক্ষায় জাস্টিসমেকার্স বাংলাদেশ এর প্রতিষ্ঠাতা মহাসচিব এডভোকেট শাহানূর ইসলামের সাথে কাজ করবে না মর্মে অংগীকার করে ১ টি  ১০০/-(একশত) টাকা ও একটি ৫০/-(পঞাশ) টাকার অলিখিত নন-জুডিশিয়াল স্টাম্পে স্বাক্ষর দিতে বলে। কিন্তু তিনি স্বাক্ষর দিতে অস্বীকার করলে সন্ত্রাসীগন তার দুহাতের আঙ্গুল সেভেন আপের বোতল দিয়ে থেতলিয়ে দেয়। পরবর্তীতে, তারা জোর করে উল্লেখিত স্টাম্প দুটিতে তার ডান হাতের বৃদ্ধা আঙ্গুলের টিপ সই নেয়। অতপর, সন্ত্রাসী গন তাঁকে বস্তায় ভরে বুড়ি গংগায় ফেলে হত্যার উদ্দেশ্যে তাঁর হাত পায়ের বাঁধন খুলে দিয়ে অজ্ঞাতনামা ২ জন আসামী  রিকশায় করে তাকে বেরী বাঁধের দিকে নিতে থাকে। এ সময় রিক্সা হাজারীবাগ ট্যালী অফিস পানির পাম্পের নিকট আসলে মি। গনেশ সন্ত্রাসী দুজনকে ধাক্কা মেরে রিক্সা থেকে লাফ দিয়ে চিত্কার করতে থাকে। এসময় আব্দুস শহীদ, ডাঃ মৃত্যুঞ্জয় এবং টিপু আহমেদসহ অনেকে এগিয়ে এসে ৭/০৬/১২ ইং তারিখ দিবাগত রাত ১২.৩০ মিনিটে (০৮/০৬/১২ ইং তারিখ ভোর) তাকে উদ্ধার করে এবং ৮/০৬/১২ ইং তারিখ ভোর ২.৩০ মিনিটে স্যার সলিমুল্লাহ মেডিক্যাল কলেজ হাসপাতালের পুরুষ ওয়ার্ডের বি-১ শয্যায় ভর্তি করেন। ইতোমধ্যে বিষয়টি সম্পর্কে এডভোকেট শাহানূর ইসলামসহ অনেকে হাজারীবাগ থানার ভারপ্রাপ্ত কর্মকর্তাকে বিষয়টি অবগত করে দ্রুত ব্যবস্থা নেওয়ার আহবান জানান। কিন্তু হাজারীবাগ থানা পুলিশ দ্রুত ব্যবস্থা গ্রহন করবে বলেও কোন ব্যবস্থা গ্রহন করেন না। পরবর্তীতে মি। গনেশ হাসপাতালে ১২/০৬/১২ ইং তারিখ পর্যন্ত চিকিত্সাধীন থেকে একটু সুস্থ হলে হাসপাতাল কর্তৃপক্ষ রিলিজ প্রদান করলে তিনি সেদিনই থানায় গিয়ে মামলা দায়ের করতে চাইলে লিখিত এজাহারে পুলিশের নাম উল্লেখ থাকায় হাজারীবাগ থানা পুলিশ তা গ্রহনে অস্বীকার করে। পরবর্তীতে ১৩/০৬/১২ ইং তারিখ হাজারীবাগ থানা পুলিশ লিখিত এজাহারে পুলিশ সদস্যের পরিবর্তে “ ছোট ছোট চুল ওয়ালা একজন” বলে উল্লেখ করে উদ্দেশ্যমূলকভাবে সঠিক ধারায় মামালা নথিবদ্ধ না করে বাংলাদেশ দন্ডবিধির ৩২৩/৩২৫/৩৭৯/৩৮৬ ধারায় একটি মামলা নথিবদ্ধ করেন। যার হাজারীবাগ থানার মামলা নং- ১৪(০৬)/১২। কিন্তু অতীব দুঃখের বিষয় মামলা গ্রহন করলেও তা তদন্তে হাজারীবাগ থানা তত্পর নয়। এমনকি অভিযুক্ত পুলিশ সদস্য ও অন্যান্য চিহ্নিত রাজনৈতিক সন্ত্রাসীদের গ্রেফতার করত সঠিকভাবে নিরপেক্ষ তদন্ত সাপেক্ষে চার্জশীট প্রদানের কোন উদ্যোগ এখন পর্যন্ত পুলিশ গ্রহন করেননি।

Bangladesh Govt failing to ensure Human Rights of Minority Hindus : Alleges JusticeMakers Bangladesh

Bangladesh government is failing to ensure protection for its citizen and Hindu community which is a ‘minority. This is alleged by ‘JusticeMakers Bangladesh’, a human rights watchdog in Bangladesh. Bangladesh is a secular ‘People’s Republic’ but having a strong dominance of the Islamic fundamentalists sinceits inception.Responding to the recent incident of vandalising and attempting to torch Hindu Loknath Temple in Hathazari near Chittagong, the ‘Justice Makers Bangladesh’ immediately came into action to reveal facts behind the incident.

This incident of communal arson attack on Hindu religion minority community in Hathazari Upazila under Chittagong District was perpetrated on February 09 and 10, 2012. Elements like radical Islamic Jamaat E Islami's cadre were suspected to do this illegitimate act against Hindus.

According to the local people, on 9 February, Hindus in the area took out a procession to celebrate the founding anniversary of Loknath Sebasram. They used microphone and drums in the procession. When the procession was passing a mosque, Muslims in the mosque forbade them to drums. At stage, someone from mosque hurled a brick bat on the procession one. An altercation took place at once which turned into chase and counter-chase when someone from the procession responded by throwing a brick bat. Police organised a meeting between the two parties. A group of Muslims said that the meeting will be held in the mosque and the Hindus agreed. The meeting started in the evening. Requesting anonymity, several of those who attended the meeting told Media that a handful of miscreants vandalised a temple on the Loknath Sebasram premises when the meeting was underway. They also vandalised seven to eight cars of the temple's visitors.

Understanding the gravity and sensitivity of the issue, JusticeMakers Bangladesh immediately formed a fact finding team of five members under the leadership of its Chief Executive Officer Adv. Shahanur Islam. The members of this team were, Adv. Mohammad Alamgir, Vice Chairman JusticeMakers Bangladesh, Ganesh Rajbonshee, fact finding officer of JusticeMakers Bangladesh.

The Fact Finding team conducted an investigation mission from February 23 to 25, 2012. During the time of investigation, the fact finding team visited the all spots of incident, talked with the victim of arson attacked as well as physical assault, talked with the eyewitness, local civil society people and local administration as well as collected the all information and documented it with video and still picture format. It was the JusticeMakers Bangladesh, which published live footage of the attack which is available on the Internet.

The JusticeMakers Bangladesh team found tremendous horror in the minds of the victims of this violence. Though the victims of violence knew most of the perpetrators, they refused to mention their identity and disclose their name scaring for imagining future trouble.

The JusticeMakers Bangladesh fact finding team documented at least 13 temples, 6 minority Hindu homes and 6 business shops which were set fire to ashes, vandalized and looted the valuable properties and also physically assaulted Hindus.

After this splendid on-the-spot investigation, JusticeMakers Bangladesh team candidly stated its observations. Leader of the JusticeMakers Bangladesh fact finding team told NewsBharati that, “The attack was preplanned and was patronized by some Islamic and non Islamic political parties trying to spread own created communal rumor of destruction of a local mosque.” The team also observed that the arson attacked, physical assault, looting and vandalizing activities have been perpetrated on the nose of local administration.

As the Hindu violence victims informed the local administration to ensure their protection, the local administration primarily assured them to ensure their security, but unfortunately due to some ‘unknown’ reason it failed to protect the Hindu Community and restrain the attack.

JusticeMakers Bangladesh also observed that during the attack, the Police machinery remain idle, blind and did nothing to stop the vandalism. Moreover, though the police registered the five criminal cases with the Hathazari as well as arrested 21 perpetrators connecting the incident. But having no coordination, it has failed to arrest the main perpetrators.

JusticeMakers Bangladesh has said that it is gravely concerned over this incident of communal arson attack on minority Hindu community in Hathazari Upazila under Chittagong district and is demanding to bring the perpetrators before the Law. JusticeMakers Bangladesh also demands urgent and impartial judicial investigation by High court judge in this case to reveal main accused behind this attack on Minority community and rehabilitate the victim of violence earliest possible.

 A  fact finding team of five members formed by JusticeMakers Bangladesh comprising Advocate Mohammad Alamgir, Vice Chairman of JusticeMakers Bangladesh, Mr. Gonesh Rajbonshee, Volunteer fact finding officer of JusticeMakers Bangladesh, led by Advocate Shahanur Islam, Founding Secretary General and Chief Executive Officer of JusticeMakers Bangladesh has been conducted a fact finding investigation mission from February 23 to 25, 2012 regarding the incident of  communal arson attacked on Hindu religion minority community in Hathazari Upazila under Chittagong District perpetrated on February 09 and 10, 2012.

During investigation the JusticeMakers Bangladesh observed that the attacked was preplanned patronizing by some Islamic and non Islamic political party spreading own created communal rumor of destruction of a local mosque. The team also observed that the arson attacked, physical assault, looting and vandalizing activities has been perpetrated on the nose of local administration. As the victims inform the local administration more time to ensure their protection and the local administration primarily assured them to ensure their security, but unfortunately due to unknown reason they failed to protect them.

JusticeMakers Bangladesh also observed that during the agitation the police showed restraint and nothing to do to stop the vandalism. Moreover, though the police registered the five criminal cases with the Hathazari as well as arrested 21 perpetrators connecting the incident, there is no coordination with each others and failed to arrest the main perpetrators. 

JusticeMakers Bangladesh gravely concerned over this incident of communal arson attacked on Hindu religion community in Hathazari Upazila under Chittagong district and demands bring the perpetrators before the book urgently after an impartial judicial investigation formed by High court judge as well as rehabilitate the victim of violence ASAP.
